What risks the parent who violates the provisions relating to the custody and placement of children?

In our legal system, the  shared custody regime, it means that parents must  jointly undertake at least the most important choices regarding education, health, education as well as that on the habitual residence of the minor. In the event that a conflict arises between the parents, it is the Judge who takes the decision through the procedure governed by art. 709-ter cpc, expressly applicable not only to disputes on the exercise of parental responsibility but also in the presence of violations by one of the parents of the conditions of custody. In the latter case, the Judge can impose financial penalties and order compensation for damage in favor of the minor or the other parent.
