Consensual separation is the best way to achieve legal separation between spouses.
It is called consensual precisely because provides the express consent of both spouses who come to an agreement on the division of their property in community and oncustody of children as well as on all possible issues related to married life.
The consent of the parties can be original if the appeal is presented by both parties but may also be subsequent, in the sense that separation can start as a court (only one instance) and then become consensual later.
The agreement between the two spouses must be subjected to the analysis of the court which, with the formalities of the council chamber, assesses that the conditions are consistent with the law and that the rights of the offspring are respected.
If the evaluation is favorable, the court approves the agreement by decree.
